These Terms and Conditions (including our Nectar Canvass Privacy Policy) govern your membership and participation in Nectar Canvass (“Member”) and set out the terms of the contract between Nectar 360 Ltd (“us/we") and each Member. A Member can register with Nectar Canvass by completing the registration process and can then earn Nectar points (“Points”) by participating in various activities on Nectar Canvass. If you apply to register with Nectar Canvass you accept these rules. We may refuse an application for any good reason.
All Members must be registered with the Nectar Programme in order to participate in Nectar Canvass. Members must be over 18.
If you have previously informed Nectar that you did not want to be contacted for market research purposes, by registering with Nectar Canvass, you acknowledge that your data choices will be amended so that Nectar may now contact you for market research purposes.
You can earn Points by taking part in an activity on Nectar Canvass, such as completing surveys or taking part in tracking studies. You will be invited to take part in such activities via email, directly from the Nectar Canvass website, or through any other channels. Each activity is voluntary. We may add or remove activities available from time to time.
The number of Points you can earn by completing an activity will be made clear to you prior to participating in the applicable activity. Points will be awarded to your Nectar account within 28 days of completing the activity unless specified when completing the activity.
Nectar may use third party sub-contractors to operate certain activities on Nectar Canvass. These terms and Conditions apply to such activities and/or websites operated for the purposes of such activities. These third party sub-contractors may have additional terms and conditions which will be made clear to you prior to participating in the applicable activity.
Points can only be earned through Nectar Canvass as set out in these Terms and Conditions. Any Points not earned in accordance with these Terms and Conditions will be deducted from your Nectar account.
You can cancel your Nectar Canvass membership at any time by unsubscribing on your Nectar Canvass Dashboard.
Nectar Canvass is strictly for personal, non-commercial use.
When participating in any activity on Nectar Canvass, you may have access to content belonging to us, our sub-contractors or any other third party (“Proprietary Content”). Such content shall remain the sole and exclusive property of such party, and in no event shall you obtain or receive any right, title and/or interest in such Proprietary Content.
You agree not to: (i) copy, modify, create a derivative work of, reverse engineer or attempt to sell or otherwise transfer any right in the Proprietary Content; (ii) use the Proprietary Content for any purpose other than the purpose of the activity as specified on Nectar Canvass; (iii) use spiders, robots or other automated data mining techniques to catalogue, download, store, or otherwise reproduce or distribute Proprietary Content, or to manipulate the results of any survey or any other activity; (iv) take any action to interfere with Nectar Canvass or an individual’s use of Nectar Canvass, including, without limitation, by overloading, “flooding”, “mail bombing” or “crashing” the Nectar Canvass website (v) send, to us, and/or to or from the Nectar Canvass website, any illegal, deceptive, or harmful code, including, without limitation, any virus, spyware, adware, or any other harmful code; (vi) open, use, or maintain more than one membership account within Nectar Canvass; (vii) forge or mask your identity; (vii) frame a portion(s) of the Nectar Canvass website within another website or alter the appearance of the Nectar Canvass website; (viii) establish links from any other website to any page of, on, or located within the Nectar Canvass website; (ix) post or transmit any threatening, libelous, defamatory, obscene, scandalous, or inflammatory material or content or any material or content that could otherwise violate applicable laws; (x) intentionally or willfully submit falsified data or commit any other fraudulent act(s), including without limitation attempt to earn Points or redeem Points in any manner conflicting with the intent of these Terms and Conditions.
You are solely liable and responsible for all content, materials, information, and comments, including, without limitation, all pictures, videos, and/or other related or similar content (“User Content”), that you use, upload, post or submit in connection with Nectar Canvass. You are solely responsible for all third party approvals, consents, and/or authorizations required for, or in connection with, User Content. By using, uploading, posting, or submitting User Content in connection with Nectar Canvass, you hereby grant to us a perpetual, irrevocable, unlimited, transferrable, sub-licensable, world-wide, royalty free, right and license to edit, copy, transmit, publish, display, create derivative works of, reproduce, modify, distribute, and/or otherwise use your User Content. All communications and submissions of User Content, by you to us shall be treated as non-confidential and non-proprietary information. You agree that we may use any such communications and User Content for any reason.
Our Nectar Canvass Privacy Policy (which is part of these Terms and Conditions) sets out what information on Members we will use, how this information will be used and who it may be shared with. We will comply with all applicable privacy laws and with our Nectar Canvass Privacy Policy which can be accessed HERE – every Member should read it carefully.
We may make changes to these Terms and Conditions and will give the Member as much notice as we reasonably can. Participating in activities on Nectar Canvass will constitute acceptance of the revised Terms and Conditions. We may suspend or terminate Nectar Canvass but will give as much notice as we reasonably can before we do so. Our only responsibilities with respect to Nectar Canvass are set out in these Terms and Conditions which are subject to English law. We will only be liable to a Member who suffers loss as a result of our breach of these Terms and Conditions and, if so, our sole liability will be to credit to the relevant Nectar Account any Points which have been wrongly deducted or should have been credited but were not. These Terms and Conditions shall not exclude or limit our liability for death or personal injury caused by our negligence.
We may suspend or terminate your Nectar Canvass account at any time if you breach these Terms and Conditions.
You agree to indemnify, defend and hold us, our subcontractors, and our respective parents, affiliates and subsidiaries harmless from and against any and all claims, liabilities, losses, judgments, awards, fines, penalties and costs and/or expenses of any kind, including, without limitation, reasonable legal fees and court costs, arising out of, resulting from, in connection with, or caused by, whether directly or indirectly,: (i) your breach or violation of these Terms and Conditions; and/or (ii) any actions taken by any individual accessing your account, with or without your consent, including, but not limited to, disclosing or changing any account access controls and any actions in connection with or regarding Points, including, without limitation, the redemption of Points.

These Additional Terms supplement the Nectar Canvass Privacy Statement and the Nectar Canvass Terms and Conditions and set forth certain terms related to a member’s (“Member” or “Your” or “Your”) participation in the Nectar Canvass market research panel (the “Panel”).
The Panel is operated by Dynata Limited (“Dynata”) pursuant to a contract between Nectar 360 Ltd (“Nectar”) and Dynata. As a member of the Panel, You will have the opportunity to participate in market research activities including online and mobile surveys, product tests, focus groups, and more. All references to “we,” “us,” or “our” refer to Dynata.
Nectar Canvass relies on accurate data to serve its clients that reflect the true opinions of the Members. As a Member, You agree that You may only open one account per person, and You agree to provide truthful and well-considered answers to our market research activities.
Dynata and the Dynata logo are trademarks of Research Now Group, LLC. Other trademarks, as well as any third-party trademarks, service marks, logos and trade names appearing on the website, the application or through the Panel, are the property of their respective owners.
To the extent permitted by applicable law:
Member agrees that use of the Panel and this website and/or application is solely at the risk of the Member.
The Panel and all services offered therein are provided on a strictly "as is" and "as available" basis, without representation or warranty of any kind.
Neither Dynata nor its third-party partners make any warranty, express or implied:
Dynata expressly disclaims any and all express, implied and statutory warranties regarding the Panel, information, services or goods provided by or through the Panel (other than those incapable of exclusion under the laws applicable to these terms), including, but not limited to:
Dynata cannot and shall not be liable or responsible for those guarantees, warranties and representations, if any, offered by clients, partners, reward partners, manufacturers of merchandise or suppliers of services.
